Terms of Uncontested Divorce
While many couples desire an uncontested divorce for the time and money saved, it is still important to know that controversial agreements still need to be made, and both parties must come to a compromise in touchy areas. These areas can include:
-
Grounds for Divorce
-
Division of Property
-
Maintenance/Alimony
-
Child Support
-
Child Custody
-
Visitation Plans
Frequently Asked Questions
-
Questions
-
Is Uncontested Divorce for Me?
Answer
It is not for every couple, or for every individual. Uncontested divorce can be convenient for no-fault divorces, but in those that are more complicated – such as divorces involving domestic violence, child abuse, or ones that lack mutual agreement on the divorce in general, it is a bad idea.
-
What If My Spouse Refuses to Sign the Paperwork?
Answer
Uncontested divorce hinges on mutual cooperation. If your spouse does not want the divorce or refuses to compromise, it will become a public divorce with court mandated hearings and procedures.
-
Are There Other Benefits of Uncontested Divorce?
Answer
Besides the fact that cost and conflict are generally lowered, soon-to-be-divorced couples enjoy a number of added benefits, including increased levels of privacy, control, and ability to negotiate.
-
Is Joint Representation Possible?
Answer
One attorney can fill out the necessary paperwork to initiate the process, but generally, it is best for each of you to have your own representation avoid conflicts of interest or perceived unfairness.
